1. Agreement to Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and APHRODAINTY (“Company,” “we,” “us,” or “our”), concerning your access to and use of the AphroDainty website as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). By accessing or using the Site, you agree that you have read, understood, and agreed to be bound by all of these Terms and Conditions, including our Privacy Policy, Shipping Policy, and Return Policy, which are incorporated by reference. If you do not agree with all of these Terms and Conditions, you are expressly prohibited from using the Site and must discontinue use immediately.

2. Eligibility

By using the Site, you represent and warrant that:

• You have the legal capacity and agree to comply with these Terms;
• You are not a minor in the jurisdiction in which you reside;
• You will not access the Site through automated or non-human means, whether through a bot, script, or otherwise;
• You will not use the Site for any illegal or unauthorized purpose, and your use of the Site will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof).

3. User Registration

You may be required to register with the Site. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

4. Purchases and Payment

We accept the following forms of payment: Mobile Money Guyana (MMG), Cash-On-Delivery (COD), and major debit and credit cards. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed.

4.1. Price Modifications All prices and descriptions shown on the Site are subject to change at any time without notice. We reserve the right to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service.

5. Order Processing and Shipping

Orders placed on the Site are subject to acceptance by the Company. We reserve the right to refuse any order for any reason. Once an order is placed, a member of our team will confirm it with you by WhatsApp or phone, and by email if you provided one. Orders confirmed before 12:00 PM, Monday to Friday, are eligible for same-day delivery; orders confirmed later are delivered the next weekday. 5.1. Delivery Updates We will let you know when your order is on its way, by WhatsApp, phone or email. You are responsible for ensuring that all delivery information is correct. The Company is not responsible for delayed deliveries or undelivered orders due to incorrect delivery information provided by you.

5.2. International Shipping At present, APHRODAINTY only ships to customers located within Guyana. We do not accept international orders.

6. Return Policy

Due to the intimate nature of our products, all sales are final. We do not accept returns, exchanges, or refunds for items that have been worn, tried on, or whose packaging has been opened or damaged, except as expressly stated in our Return Policy. You agree to review all product details before purchasing. If an item is defective or damaged upon receipt, please contact us within 3 days of receipt for assistance.

7. Intellectual Property Rights

All content on the Site, including but not limited to text, graphics, logos, images, video clips, and data compilations, is the exclusive property of APHRODAINTY or its licensors and is protected by copyright, trademark, and other intellectual property laws. Unauthorized use, reproduction, or distribution of the content is strictly prohibited and may result in civil or criminal penalties.

8. Third-Party Links

The Site may contain links to third-party websites or services that are not owned or controlled by APHRODAINTY. We do not assume any responsibility for the content, privacy policies, or practices of any third-party websites. You acknowledge and agree that we shall not be responsible for any damage or loss caused or alleged to be caused by or in connection with your use of any such content, goods, or services available on or through any such third-party websites or services.

9. Prohibited Activities

You may not access or use the Site for any purpose other than that for which we make the Site available. As a user of the Site, you agree not to:

• Engage in any unauthorized use of the Site, including collecting usernames or email addresses of users by electronic or other means for the purpose of sending unsolicited email;
• Bypass or disable any measures used by the Site to prevent or restrict access to the Site, or any portion of the Site;
• Upload or transmit any viruses, worms, or any other harmful material;
• Use the Site to defame, abuse, harass, or threaten others.

10. Disclaimer of Warranties

The Site and its content are provided on an “as is” and “as available” basis. We make no representations or warranties of any kind, express or implied, regarding the operation of the Site or the information, content, materials, or products included on the Site. To the fullest extent permissible under applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

In no event shall APHRODAINTY, its directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses arising from your use of the Site, even if we have been advised of the possibility of such damages. Our liability in connection with any claim will not exceed the total amount paid by you for the product at issue.

12. Indemnification

You agree to indemnify, defend, and hold harmless APHRODAINTY and its affiliates, employees, agents, and licensors from any claims, liabilities, damages, judgments, losses, costs, expenses, or fees (including reasonable attorney’s fees) arising from your breach of these Terms or your use of the Site.

13. Governing Law

These Terms and your use of the Site shall be governed by and construed in accordance with the laws of The Co-Operative Republic of Guyana, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of Guyana and all courts located in Guyana for the resolution of any disputes.

14. Dispute Resolution

Any dispute arising out of or related to these Terms shall be resolved through binding arbitration in accordance with the Arbitration Act of Guyana. The arbitration shall take place in Georgetown, Guyana. The award rendered by the arbitrator shall be final and binding, and judgment may be entered upon it in any court of competent jurisdiction within Guyana.

15. Amendments

We reserve the right to modify or update these Terms at any time, with or without prior notice. Any changes will be effective immediately upon posting to the Site. Your continued use of the Site after the changes are posted constitutes your acceptance of the revised Terms.
